The session will focus on compliance with the new Minnesota E-911 law and other E-911-related civil and criminal liability concerns facing companies and institutions. Teaming with RedSky in the on-line seminar will be Mr. Mark Lies, a partner and senior member of the environmental health and workplace safety practice for Seyfarth Shaw LLP. New laws, changing technology and evolving legal and regulatory standards are raising new or higher hurdles for business owners, leaders and decision- makers who operate large multi-line telephone systems (MLTS). For example, Minnesota's new PBX E-911 law, signed by Governor Tim Pawlenty last May, is intended to protect office workers by ensuring businesses provide the same level of 911 protection for employees in the workplace as they have at home. The responsibility rests on individual businesses in Minnesota to provide this capability. This 30-minute event will provide practical information to help company and government leaders and decision-makers -- including CEOs, CIOs, General Counsel, Security and Risk Managers, and public safety officials -- understand the liability risk to their companies and the efficient, cost-effective tools available to help them comply with the new Minnesota E-911 law. "If enterprise phone systems are not configured to pinpoint the location of an emergency caller within a building or campus complex, and automatically provide that information to authorities, they could be subjecting their owners to undue risks," said Lies. "A civil suit could be filed seeking damages that would far outweigh what might be provided with worker's compensation." Issues to be discussed during this free event include: -- Statutory requirements for compliance for E-911 in Minnesota. New compliance standards are embodied in the Minnesota E-911 law that took effect January 1, 2005. The law applies to owners and operators of Multi-Line Telephone Systems (MLTS) - PBX and Centrex systems - used in private businesses, hotels and motels, residential units, and educational institutions, including schools and colleges. What requirements apply to what systems and users? -- When non-compliance may constitute negligence. Conducting a realistic and effective risk assessment that includes multi-level litigation exposure - worker's compensation, negligence, and OSHA - for employees, visitors, contractors, non-employees, part- time or contract workers. Addresses such issues as implications when E-911 technology is readily available; what is the cost of a life; workers compensation exceptions; and potential for wrongful death and common-law negligence action. -- Other state laws, liability in states with no statutory requirement and FCC activities. In the last two years, three states -- including Minnesota -- have passed E-911 legislation. There are now twelve states that have some form of E-911 requirement including Arkansas, Colorado, Connecticut, Florida, Illinois, Kentucky, Louisiana, Minnesota, Mississippi, Texas, Washington State and Vermont. The FCC is currently urging other states to implement statutory requirements for enhanced 911 because the technology is readily available today and it is not cost-prohibitive to implement.
